Morocco does not regulate outbound calling through a telemarketing rulebook. It regulates it through a data protection statute, loi 09-08, supervised by the CNDP, and through the ANRT declaration regime that a commercial messaging sender has to sit inside. That changes where the work is. There is no register to scrub, no prefix to present and no published calling window to schedule against. What there is, instead, is a filing you must make before you start, a consent test that differs depending on whether a machine or a person dials, and a penalty structure that reaches imprisonment.
The consent distinction is the one most teams get wrong. Article 10 bans direct prospection by automated calling machine, fax or email to anyone who has not given prior consent to that means. An auto-dialler, an IVR broadcast or an AI voice agent is inside that ban. A marketing call dialled by hand is not, and answers instead to the general article 4 consent requirement and the article 9 right to object free of charge. Treating both campaign types identically either over-restricts your agents or under-protects your automated traffic.
Calling hours are the honest gap. No hours, day-of-week or holiday rule was found in loi 09-08, in ANRT's published decisions or in the national numbering plan, and the likeliest home of a canvassing rule, loi 31-08 on consumer protection, is published as an image-only scan that could not be read. Anyone quoting you a Moroccan calling window should be asked for the article it comes from. Until that is settled, set a conservative window as policy and keep it easy to change.
Retention deserves the same care. Article 3 makes retention purpose-bound, and article 55 makes keeping data beyond the period you declared a criminal offence, so the number you write on your CNDP filing becomes the number your system has to hold to. Cross-border processing runs on an adequacy list the CNDP establishes, with derogations in article 44 where a destination is not on it, so check the list before an offshore contact centre or cloud region goes live.
