Turkey Regional Guide
Outbound calling rules in Turkey (Türkiye).
A working guide for teams calling into Türkiye: what to do before the first dial, how to take a consent that holds, who you may call without one, what to say in the first seconds, and what the law does not say.
Last reviewed October 22, 2026
Quick answer
Commercial calls into Türkiye fall under the Ministry of Trade and Law No. 6563. Register on İYS, check İYS for a live consent on the exact channel before each send, upload any consent taken elsewhere within three business days, and stop within three business days of a refusal. No calling-hours rule was found in the instruments read. Your team runs the İYS check and upload; DialerBee holds consent records and suppression and applies them at the dial, as compliance-supporting controls.
Key Considerations
What to know about Turkey outbound calling
The Ministry of Trade sets the rules
Who you may call and what you must say belong to the Ministry of Trade under Law No. 6563, not to the telecoms regulator BTK. Personal data sits with the KVKK authority. There is no telemarketing licence.
İYS is a gate, not a list
İYS is both the consent register and the refusal register, with voice, SMS and e-mail held separately. The duty is a check before each send, not a periodic download of a suppression file.
Two three-business-day clocks
Upload a consent taken outside İYS within three business days or it is invalid. Stop sending within three business days of a refusal, and report refusals you receive to İYS within three business days.
No calling-hours rule found
Law 6563, the commercial-message regulation and the sector's consumer-rights regulation contain no clock window, day-of-week rule or holiday rule. Whether one exists elsewhere could not be confirmed.
The full legal analysis, with the instruments and fine tables, is in our Türkiye İYS and KVKK compliance guide. For the DialerBee product overview for Turkish teams, see AI call center software for Türkiye.
Before the first dial
What do you have to do before calling Turkey?
A Turkish campaign is won or lost before anyone picks up a headset. The definition of a commercial electronic message names telephone, call centres, automatic dialling machines and smart voice-recording systems, so a predictive campaign or a voice agent making offers is inside the rules from the first attempt. Work through these steps in order.
- 1
Register on İYS
Registration is mandatory for every natural or legal person wishing to send commercial electronic messages. Each registered service provider and each of its brands gets its own İYS number; record the number for every brand you call under.
- 2
Check your outsourcer's position
If a contact centre or platform starts the send for you, it is an intermediary service provider with its own duties: it must not send for an unregistered service provider and must check İYS consent before starting.
- 3
Reconcile old consents
Any consent taken outside İYS that was never uploaded is invalid. A signed paper form in a filing cabinet gives you no defence, and the burden of proving a non-İYS consent is yours.
- 4
Split the list by channel
Keep voice, SMS and e-mail permissions apart in your data. A contact with SMS consent and no call consent is not callable.
- 5
Separate reminders from offers
Debt reminders and service notices sit outside the consent duty only while nothing is promoted in the same contact. Build them as their own campaigns with their own scripts.
- 6
Write the opening line
Trade name first, the purpose stated at the start where it is not obvious, and a reachable contact route. Details below.
- 7
Decide your own calling window
No statutory window was found, so the hours you call are a policy choice. Confirm with the Ministry of Trade and your sector regulator before launch.
- 8
Put a safeguard under any transfer abroad
If you dial Türkiye from another country, Turkish personal data leaving Türkiye needs an adequacy decision, an appropriate safeguard such as the standard contract, or an occasional derogation.
Consent that holds
How do you take a valid consent in Turkey?
The model is prior opt-in. Consent may be taken in writing, through any electronic communication tool, or through İYS itself, and each route has its own formalities.
| How consent is taken | What it must carry | Deadline |
|---|---|---|
| On paper | Positive statement of will, name and surname, electronic contact address, and the signature of the person giving it | Upload to İYS within three business days |
| Electronically (web form, call, app) | Positive statement of will, name and surname, electronic contact address | Confirm back to the recipient within 24 hours with a chance to refuse, and upload to İYS within three business days |
| Through İYS | Positive statement of will and contact address | No 24-hour confirmation needed |
| Inside a contract | At the end of the document, before the signature, under a "commercial electronic message" heading, with a refusal option, in at least twelve-point type | Upload to İYS within three business days |
Three things are never allowed: asking for consent by sending a commercial message to someone's contact address, pre-selecting the positive statement in the consent text, and making consent a condition of supplying the goods or service. No expiry or re-confirmation duty is published, but every send still needs a live consent in İYS at the moment it goes out.
Carve-outs
Who can you call in Turkey without prior consent?
| Who or what | Prior consent? | İYS step | The catch |
|---|---|---|---|
| Consumers, for offers | Yes | Live consent on that channel, checked before each send | A refusal on one channel ends that channel only |
| Traders and tradesmen | No | Load their contact addresses into İYS and check for a refusal before sending | The İYS step does not disappear for business contacts |
| Collection and debt reminders | No | None | Nothing may be promoted in the same contact, or the exemption is lost |
| Subscription, membership and partnership notices, information updates, purchase and delivery notices, statutory information | No | None | Same condition: no goods or service encouraged or promoted |
For collections floors this is the most useful line in the regime, and the easiest to cross. A reminder call that ends with "and while I have you, we have a new card offer" turns an exempt notice into a commercial message that needed consent. Keep the reminder script, the SMS templates and the campaign itself separate from anything that sells.
The first seconds
What must a Turkish commercial call say at the start?
Türkiye regulates who you say you are rather than what number you show. Build every agent script and voice-agent opening around four elements:
Trade name
The registered trade name for a trader, or first name and surname for a tradesman. A brand or business name may be added.
Purpose, at the beginning
Where the commercial nature is not obvious, a qualifying word such as promotion, campaign or information, stated at the start of the conversation.
A reachable contact route
At least one: a telephone, fax or SMS number or an e-mail address. Promotions, prize draws and games are flagged as such, with conditions reachable.
Recording notice
Not a Law 6563 duty, but a recording is personal data under KVKK. Announce it at the start and cover it in your KVKK information notice.
No reserved prefix or number range for telemarketing is published, and rules on withheld or spoofed caller ID for commercial calls were not located. The prudent build is a consistent, reachable number that matches the trade name your agents announce; confirm the numbering position with BTK if your setup depends on it.
Hours and frequency
What hours can you call in Turkey?
No calling-hours rule was found. A full read of Law No. 6563, the consolidated commercial-message regulation and the electronic communications sector's consumer-rights regulation found no clock window, no day-of-week restriction and no public-holiday restriction for commercial electronic messages, and no instrument names a time zone. No frequency cap appears either.
That is a finding about the instruments read, not permission to call at any hour. Whether a Ministry of Trade communiqué, a BTK board decision or a sectoral banking or insurance rule sets a window could not be confirmed. Confirm the position with the Ministry of Trade and your sector's regulator before launch, and do not accept a Turkish calling window from any vendor as though it came from Law 6563.
The control the law does give is the citizen's: a free, unconditional refusal that must be honoured within three business days. Campaigns that irritate produce refusals, a refusal ends consent on that channel, and lost consent is not recoverable by dialling again. In practice, the calling window and attempt limits you choose are part of protecting your İYS base.
Messaging
Do SMS and WhatsApp follow the same rules?
SMS does. It is named in the definition, it is one of the three İYS permissions, and every content duty applies: trade name, the qualifying word where needed, a reachable contact route, and a free refusal route on the same channel in every message. A contact centre sending SMS for a client carries the full pre-send İYS check; only e-mail is carved out of the intermediary duties.
WhatsApp and other over-the-top channels are not named in Law 6563 or the regulation, and the instruments do not answer how they map onto the definition. Treat consent, identification and refusal as the floor, and confirm the treatment of over-the-top messaging with the Ministry of Trade rather than assuming either answer.
Records and penalties
What records must you keep, and what does a mistake cost?
Consent records are kept for three years from the date the consent ceased to be valid; other commercial-message records for three years from the record date. Both are produced to the Ministry on request, and in a complaint the burden of proof lies with the service provider and, where relevant, the intermediary. Call recordings have no statutory retention period in this regime, so set one deliberately under your own KVKK policy.
Personal data falls under KVKK, Law No. 6698. Since 1 June 2024, under Law No. 7499, a transfer of Turkish personal data abroad runs on three tiers: an adequacy decision, an appropriate safeguard such as the Kurul's standard contract, or an occasional derogation. A standard contract must be notified to the Authority within five business days of signature. For a contact centre dialling Türkiye from another country, this is the highest-risk item in the file.
Worked example: one non-consented bulk send in 2026
- 2026 band for a send without consent: TRY 2,859 to 14,309 per breach (Ministry of Trade communiqué, Resmî Gazete 25 December 2025, No. 33118).
- A send to more than one person at once in breach can be raised up to tenfold: TRY 14,309 × 10 = TRY 143,090 upper bound.
- The same breach repeated within one year of the penalty notice is fined at twice the previous fine: 2 × TRY 143,090 = TRY 286,180.
- KVKK fines are separate, with statutory base figures from TRY 5,000 to 1,000,000 depending on the duty breached.
Your team and the platform
Which steps does DialerBee support, and which stay with you?
DialerBee provides compliance-supporting controls. Türkiye does not ship as a jurisdiction pack, so calling hours, do-not-call handling and consent are configured on your tenant, and the legal responsibility stays with you as the service provider.
| Step | Who does it |
|---|---|
| İYS registration, the İYS check before each send, and the three-business-day upload | Your team. DialerBee does not run the İYS query or upload. |
| Consent records per contact, with revoke | DialerBee: consent created, updated and revoked as auditable records, checked before the attempt |
| Refusals stopping further calls | DialerBee: a revocation or suppression entry takes effect on the next attempt, not the next list refresh |
| Your chosen calling window and attempt limits | You decide the policy; DialerBee applies calling hours per time zone and frequency limits at the dial |
| Reminders kept apart from offers | DialerBee: separate campaigns and template libraries per traffic type |
| Opening script with trade name and purpose | You write it; DialerBee keeps campaign configuration and templates reviewed before launch, with an audit trail on every rule override |
| A consistent, reachable number | DialerBee: caller-ID pools owned per tenant, mapped per campaign, numbers on your own carriers under BYOC |
| Evidence for a Ministry request | DialerBee: an audit trail on every consent change, with auditor export, to reconcile against your İYS uploads |
| Recording retention | You set the policy; DialerBee offers configurable retention, legal hold and per-tenant isolation |
